Is AI calling legal in India?
Yes, AI calling is legal in India. No Indian law bans a business from using an AI voice agent to place or answer calls. The calls must follow the same rules as any commercial calling: TRAI's TCCCP Regulations 2018 (DLT registration, approved number series, DND screening), the DPDP Act 2023 for personal data, and any sector rules from RBI, IRDAI or SEBI that apply to your business.
What the law actually regulates
Indian telecom rules regulate commercial communication, not the technology that produces it. The Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCP 2018), issued by TRAI and amended several times since, apply equally to a call placed by a human telecaller, an auto-dialer or an AI voice agent. The purpose of the call, promotional, service or transactional, decides which obligations apply.
Nothing in TCCCP 2018, the Telecommunications Act 2023 or the DPDP Act 2023 prohibits conversational AI from speaking on a business's behalf. What has changed is enforcement. TRAI's August 2024 direction told operators to cut off promotional voice calls, including pre-recorded and computer-generated calls, from unregistered senders using SIP, PRI or other connections.
The four layers that apply
- —Telecom rules: DLT registration of the business, the right number series for the call type, and DND screening for promotional calls under TCCCP 2018.
- —Data protection: the DPDP Act 2023 governs the phone numbers, recordings and transcripts the calls generate, with the DPDP Rules 2025 being phased in.
- —Sector rules: RBI's recovery-agent and Fair Practices Code expectations for lenders, IRDAI rules on insurance solicitation, SEBI rules on investment advice, RERA for property marketing.
- —General law: the Consumer Protection Act 2019 applies to whatever the agent says, and misleading claims are the business's responsibility.
Where AI calling becomes illegal
The usual problems are not about AI at all: promotional calls from an unregistered 10-digit number, calling DND numbers without valid consent, dialling a scraped database, calling late at night, or a collection script that threatens borrowers. An AI agent repeats whatever its script and list allow, at scale, so a mistake multiplies faster than it would with one telecaller.
How Outpero fits
Outpero calls from a DLT-registered calling line, screens bulk campaign lists against DND before dialling and lets each campaign set its own calling window. The business still owns its consent records, its script and its sector obligations.
This page summarises the framework in plain language. TRAI and other regulators amend these rules often, so confirm your specific set-up with your telecom operator or a lawyer who works on telecom and data protection.

Follow-up questions
Is there a special licence for AI calling in India?
+
No separate licence exists for AI calling. A business running promotional calls registers as a principal entity on an operator's DLT platform, and promotional calls go out through registered telemarketers on approved number series. Regulated sectors such as lending, insurance and investment advice carry their own licensing, which applies whether a human or an AI makes the call.
