Is call recording legal in India?
Yes, businesses in India commonly record calls, and no general statute requires every party's consent before a business records its own calls. Recordings are personal data under the DPDP Act 2023, so you need a lawful purpose, a clear notice, reasonable security and deletion once the purpose is served. Announcing the recording at the start of the call is standard practice and the safest approach.
The legal position
India has no single statute like the 'all-party consent' recording laws in some US states. The Indian Telegraph Act 1885, now largely replaced by the Telecommunications Act 2023, dealt with interception by the government, not a business recording calls it is a party to. The Supreme Court's 2017 Puttaswamy judgment recognised privacy as a fundamental right, which shapes how courts view covert recording.
For businesses, the practical law is the DPDP Act 2023. A recording captures a voice and usually a name and number, so it is personal data. Section 5 requires notice, Section 6 sets the standard for consent, and Section 8 requires reasonable security safeguards and erasure when the purpose is served.
Where recording is expected
- —Insurance: IRDAI's distance-marketing rules have long expected tele-sales calls to be recorded and kept for resolving disputes.
- —Broking: SEBI-regulated brokers rely on recordings as evidence of orders placed by phone.
- —Lending: recordings of collection calls help show that RBI's conduct rules for recovery were followed.
- —Any business: a recording is the best evidence of what was actually promised.
Good practice
- 01Announce recording in the first lines of the call.
- 02Record only for stated purposes such as quality, training and dispute resolution.
- 03Restrict access to the people who need it.
- 04Set a deletion period and follow it, unless a sector rule requires longer retention.
- 05Keep transcripts and summaries under the same rules as audio, since they hold the same personal data.
How Outpero handles it
Outpero keeps a recording and full transcript of every call, outbound and inbound, in your dashboard and can send them to your webhook. Your script carries the announcement, and your retention policy decides how long exported copies are kept.
Covert recording and its use as evidence raise separate questions. If recordings may end up in a dispute, take advice from counsel on how to store and produce them.

Follow-up questions
Can a business use call recordings to train its staff or its AI?
+
It can, if the notice given to the caller covers that purpose. Under the DPDP Act 2023, personal data should be used for the purposes stated when it was collected. If the opening line mentions quality and training, reuse for training is easier to defend, and removing names and numbers first is safer still.
