What happens if a business makes unregistered telemarketing calls in India?
The consequences are mainly operational and severe. Under TRAI's TCCCP framework and its August 2024 direction, operators can bar all of an unregistered sender's outgoing services for 15 days on a first violation, and disconnect all its telecom resources and blacklist it for one year on repeat violations, with the details shared across operators so the business cannot simply switch. The August 2024 direction first applied this approach, with blacklisting of up to two years. Check the current text.
How enforcement works
Enforcement under TCCCP 2018 is complaint-led and run by the telecom operators. A person reports an unsolicited call to 1909 or through the TRAI DND app. The operator investigates, and if the sender is making promotional calls without registration, action follows on the numbers and connections involved.
TRAI's August 2024 direction removed most discretion. Unregistered senders making promotional voice calls, including pre-recorded and computer-generated calls, through SIP, PRI or other telecom resources were to have all their telecom resources disconnected and be blacklisted for up to two years, with the information shared across operators. The February 2025 amendment to TCCCP 2018 then set the ladder in the regulation itself: a 15-day bar on outgoing services for a first violation, and disconnection of all telecom resources and blacklisting for one year for second and later violations.
What it costs a business in practice
- —Loss of every number and trunk the business uses, including those customers call for genuine service.
- —Months of disruption while new connections are refused during blacklisting.
- —Brand damage as people mark the business's numbers as spam on caller ID apps.
- —Possible complaints under the Consumer Protection Act 2019 and, where personal data was misused, the DPDP Act 2023.
Common ways businesses end up here
- —A vendor sells bulk calling on ordinary 10-digit SIM numbers to avoid the lower pickup of 140-series calls.
- —A sales team uses personal mobiles to cold call a purchased list.
- —A tool blasts pre-recorded promotions through an unregistered SIP trunk.
How to stay clear
Register on DLT or work through a provider whose line is registered, keep promotional and service traffic separate, screen lists against DND and keep evidence of consent. Outpero calls from a DLT-registered line and screens bulk lists against DND, but the classification of each campaign is still yours.
A short test: if a vendor cannot tell you your DLT entity ID, the number series your calls use and which operator carries them, treat the offer as unregistered calling, however low the price.
TRAI's 2025 amendment also changed complaint thresholds and the obligations of operators in the enforcement chain. Read the current regulation rather than relying on a summary, including this one.
