Is an AI voice agent treated as a robocall under Indian rules?

Short answer

For telecom compliance, effectively yes when it makes promotional calls. TRAI's August 2024 direction covered pre-recorded and computer-generated promotional calls from unregistered senders, so an AI voice agent pitching a product is held to TCCCP 2018 like any robocall or telecaller: DLT registration, 140-series numbers and DND screening. The experience for the caller differs; the compliance obligations do not.

Robocalls versus AI agents

A robocall in the usual sense is a one-way, pre-recorded message played to a list: 'press 1 to know more'. An AI voice agent holds a two-way conversation, understands replies and answers questions. To the person receiving the call, the experience is very different. To a regulator counting unsolicited calls, both are automated commercial calls.

Where Indian rules draw lines

  • —TCCCP 2018 regulates commercial communication by purpose, not by technology.
  • —TRAI's August 2024 direction expressly named pre-recorded and computer-generated calls among the promotional calls it was acting against.
  • —Service calls, such as reminders and confirmations to existing customers, are treated as service calls whether a person, a recording or an AI makes them.
  • —Inbound calls, where the customer rings the business, are outside the telemarketing rules altogether.

Why the difference still matters

People complain about robocalls mainly because they cannot answer back, ask a question or say 'stop calling me' to a recording. An AI agent that opens with the business name, explains why it is calling and ends the call when asked removes those frustrations. It also produces a transcript of every call, which helps prove what was actually said if a complaint arrives.

That does not make an AI agent exempt from anything. A badly targeted AI campaign to a purchased list is still unsolicited commercial communication, however polite the voice.

How Outpero fits

Outpero offers both formats. Its AI employee holds real conversations in Hindi, Telugu, Tamil, Marathi, Kannada, Malayalam and Indian English, while its separate voice broadcast mode plays one fixed message to a list and ends the call. Both run on a DLT-registered line, and both must follow the same rules when used for promotion.

Global contrast

In the US, the FCC ruled in February 2024 that AI-generated voices count as 'artificial' voices under the TCPA, so such calls need prior consent. India has no equivalent ruling yet; watch for updates from TRAI and MeitY.
