Outpero

Are automated calls, auto dialers and AI dialers legal in India?

Short answer

Yes, the technology itself is legal: no Indian law bans automated calls, auto dialers or AI dialers. What is regulated is the call. Commercial calls fall under TRAI's TCCCP Regulations 2018, which cover DLT registration, approved number series and DND screening, and personal data falls under the DPDP Act 2023. Confirm specifics with your telecom operator or counsel.

The law looks at the call, not the dialler

India has no statute that makes an auto dialer or an AI dialer illegal. A person dialling from a list and a machine dialling the same list are treated the same: both are making a call, and the rules depend on what the call is for and who it reaches.

The instruments that apply

InstrumentWhat it covers
TRAI TCCCP Regulations 2018 and amendmentsCommercial communication: DLT registration, number series for promotional and service calls, preference registers (DND), consent and complaints
DPDP Act 2023How personal data, including phone numbers and recordings, is collected, used and stored
Sector rules from RBI, IRDAI or SEBIWhat lenders, insurers and brokers may say and when they may call
Your telecom operator's termsConditions on the line you use, including automated calling

Where businesses get into trouble

  • —Promotional calls from an ordinary mobile number instead of the series meant for them.
  • —Calling numbers on DND without valid consent.
  • —Using purchased or scraped lists with no consent record.
  • —Ignoring opt-out requests and complaints.
  • —Calling outside permitted hours for the call category.

The exact penalties and procedures are set out in the regulations and by the operators. They are not repeated here, because they change; read the current text on trai.gov.in or ask your operator.

How Outpero is set up

Outpero's calls go out on a DLT-registered calling line, bulk campaigns screen numbers against DND before dialling, and the ₹649/month dedicated number includes the compliance and carrier fees that come with it. The business still decides whom to call and why, so keep a record of consent, honour opt-outs and say who is calling.

If your campaign is promotional, regulated by a sector body or aimed at a bought list, take advice before launching. This page is general information, not legal advice.
